Minnesota Postpones Chemical Restriction Enforcement for Certain Goods

GENEVA, SWITZERLAND / AGILITYPR.NEWS / September 13, 2024 / SGS, the world’s leading testing, inspection and certification company, has summarized Minnesota’s delay in enforcing restrictions on per- and polyfluoroalkyl substances (PFAS), lead and cadmium.

Many PFAS, also known as ‘forever chemicals’ because they persist and accumulate in the environment, are now recognized as toxic to human, animal and plant health, causing a range of health problems.

HF 2310 (Chapter 60) was approved by the US state of Minnesota in 2023. It regulated PFAS and two heavy metals in a variety of consumer products. Subsequently, the state’s Pollution Control Agency (MPCA) issued two separate guidelines in 2024, detailing the prohibitions.

In May 2024, HF 3911 (Chapter 116) was approved. This contains a section authorizing the commissioner of the MPCA to delay enforcement of the 2023 law to July 1, 2025. It also requires a report from the state legislature on the use of PFAS, lead and cadmium, by January 31, 2025.

SGS experts publish SafeGuardS to keep stakeholders informed about regulations that may impact their business. SafeGuardS 136.24 includes a helpful table summarizing the scope of HF 3911, together with requirements and new effective dates.
