WASHINGTON, DC / AGILITYPR.NEWS / November 06, 2026 / NABIP Secures Court Victory Immediately Lifting CMS Moratorium on New Agent and Broker Registration
Washington, D.C. — The National Association of Benefits and Insurance Professionals (NABIP) secured a court victory yesterday when the U.S. District Court for the District of Maryland ruled in its favor, immediately lifting the Centers for Medicare & Medicaid Services (CMS) moratorium on new agent and broker registration for the federal Marketplace. Training for new agents and brokers will begin today, November 6.
The moratorium had blocked approximately 19,000 licensed agents and brokers who were not registered with the federal Marketplace for Plan Year 2026 from registering to assist consumers with Plan Year 2027 coverage. Today’s ruling clears the way for these licensed professionals to complete the required training and registration and deliver much-needed guidance to consumers during Open Enrollment.
“Today’s ruling is a significant victory for licensed agents and brokers and the consumers who rely on their expertise,” said NABIP President Mychal Walker. “With Open Enrollment already underway, every day matters. “Lifting the moratorium immediately and beginning training tomorrow will help affected professionals get to work assisting individuals and families in finding coverage that fits their needs and budgets.”
NABIP filed its lawsuit on October 15 to challenge the federal rule and resulting moratorium that prevented new agents and brokers from completing the training and registration required to assist consumers through the federal Marketplace.
“NABIP supports strong oversight and meaningful action to prevent fraud and protect consumers,” Walker added. “Those efforts must also preserve the ability of qualified, licensed professionals to serve their clients. This victory advances the vision of NABIP's Healthcare Consumer Bill of Rights: helping consumers access the coverage and professional guidance they need to make informed healthcare decisions.”
Case: National Association of Benefits and Insurance Professionals v. Robert F. Kennedy, Jr., et al., No. 1:26-cv-04311-SAG, U.S. District Court for the District of Maryland.
