SGS Reminds Stakeholders of Canadian Compliance Guidance for Consumer Product Lead Regulations

GENEVA, SWITZERLAND / AGILITYPR.NEWS / February 16, 2022 / SGS, the world’s leading testing, inspection and certification company, is advising stakeholders that Health Canada has issued guidelines relating to the safety requirements under the Consumer Products Containing Lead Regulations (CPCLR), which falls under the Canada Consumer Product Safety Act (CCPSA). 

Entitled ‘Information for Regulated Parties Regarding the Consumer Products Containing Lead Regulations’, the guidelines were issued in January 2022. It contains several important points that are of relevance to stakeholders. These include:

• Several examples of consumer goods that are within the scope of each of the five product categories:

1. Products that are brought into contact with the user’s mouth during normal use
2. Clothing or clothing accessories for children under 14 years of age
3. Products for use in learning or play by children under 14 years of age
4. Books or similar printed products for children under 14 years of age
5. Products that are designed and intended to facilitate the relaxation, sleep, hygiene, carrying or transportation of a child under 4 years of age

• Clarifies that an accessible part in CPCLR means ‘any part of a product that may be touched, licked, mouthed, or swallowed during the reasonably foreseeable use of the product.’
• Clarifies that ‘reasonably foreseeable use’ does include normal wear and tear
• Emphasizes that lead content in consumer products is also restricted in several regulations under the CCPSA, including:

1. Children’s Jewelry Regulations
2. Surface Coating Materials Regulations
3. Toys Regulations
4. Glazed Ceramics and Glassware Regulations

The CPCLR was published in May 2018 and came into effect in November 2018. It restricts lead content to no more than 90 mg/kg in each accessible part of five categories of consumer goods.

However, each accessible part can contain more than 90 mg/kg lead content provided ALL the following three conditions are met:

• Use of lead is necessary for an essential characteristic
• No alternatives are available
• It contains no more than 90 mg/kg migratable lead using EN 71-3 or when tested in accordance with good laboratory practices
