GENEVA, SWITZERLAND / AGILITYPR.NEWS / July 10, 2025 / Geneva (July 10, 2025) – SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 093.25 to highlight a proposed rule by Washington State’s Department of Ecology (DoE) to regulate per- and polyfluoroalkyl substances (PFAS) in consumer products.
Issued on June 4, 2025, the preliminary draft rule is part of Cycle 1.5 under the Safer Products for Washington Program (RCW 70A.350), which aims to reduce toxic chemicals in consumer products to protect public health, the environment and vulnerable communities. While also currently in Phase 2 of its second rulemaking cycle, the DoE introduced Cycle 1.5 as an interim step specifically to address PFAS-related concerns.
Under this proposal, PFAS would be prohibited in three product categories if intentionally added, starting January 1, 2027. These categories include apparel not intended for extreme or extended use, automotive washes and cleaning products. The remaining nine product categories, such as footwear, cookware, gear for recreation and floor care products, would be subject to mandatory reporting requirements. Manufacturers would be required to report the presence of intentionally added PFAS by January 31, 2027, and annually thereafter. The rule also presumes the presence of PFAS if total fluorine is detected, unless manufacturers provide verifiable evidence that PFAS were not intentionally added.
Once finalized, the rule would amend Chapter 173-337 of the Washington Administrative Code (WAC). Public comments are being accepted through July 20, 2025, and the final rule is expected by the end of 2025.
